  • Obtain prior express written consent for marketing messages where required

  • Maintain records of consent (opt-in logs)

  • Honor all opt-out requests immediately

  • Comply with all applicable laws, including:

    • Telephone Consumer Protection Act (TCPA)

    • CAN-SPAM Act

    • Any applicable state or international regulations

You are solely responsible for how contact data is collected and used.

ScaleNGN does not verify consent and relies on your compliance.

8. No Liability for Messaging Content

ScaleNGN acts as a platform provider and message facilitator.

We are not responsible for:

  • The content of messages sent by businesses

  • Whether proper consent was obtained

  • Any claims arising from SMS communications

ScaleNGN provides messaging services on behalf of businesses and does not control the content, timing, or recipient lists used by those businesses.

9. Data Usage

Phone numbers collected for SMS communications are used solely for:

  • Delivering requested messages

  • Service-related communications

We do not sell, rent, or share SMS opt-in data with third parties for marketing or promotional purposes.

10. Supported Carriers

SMS delivery depends on third-party mobile carriers.
